1. Acceptance of Terms

By accessing and using NyxoPOS ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

NyxoPOS provides a cloud-based point of sale system designed for restaurants and food service businesses. The Service includes:

  • Order management and processing
  • Menu and inventory management
  • Payment processing integration
  • Sales reporting and analytics
  • Staff management and access control
  • Multi-location support

3. User Accounts

To use the Service, you must:

  • Create an account with accurate and complete information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized access
  • Be responsible for all activities that occur under your account
  • Not share your account with others

4. Subscription and Payment

Free Trial: New users receive a 14-day free trial period. No credit card is required for the trial.

Paid Subscriptions: After the trial period, continued use requires a paid subscription. Subscription fees are billed in advance on a monthly or annual basis.

Cancellation: You may cancel your subscription at any time. Cancellation will be effective at the end of the current billing period.

Refunds: We do not provide refunds for partial months of service or unused time on a subscription.

5. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We take data security seriously and implement industry-standard measures to protect your information.

You retain all rights to your data. You may export or delete your data at any time through the Service.

6. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service
  • Use the Service to transmit viruses or malicious code
  • Reverse engineer or decompile any portion of the Service
  • Resell or redistribute the Service without permission

7. Service Availability

We strive to maintain 99.9% uptime but cannot guarantee uninterrupted access to the Service. We may temporarily suspend the Service for maintenance, updates, or other operational reasons. We will provide advance notice when possible.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by NyxoPOS and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

9. Limitation of Liability

To the maximum extent permitted by law, NyxoPOS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

10. Modifications to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated terms.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.
